A Federal High court sitting in Umuahia the state capital, has granted the exparte motion in a suit brought before it by one Isaac Alozie against the Code of Conduct Bureau, the chairman Isiala North Local Government Chief Ginger Onwusibe, the state chairman Peoples Democratic Party chief Johnson Onuigbo.
The Court presided over by Justice E. N. Anyadike also directed the CCB, “To invite, investigate and prosecute Onwusibe for his errant refusal and failure to declare his assets upon the assumption of office as chairman of Isiala Ngwa North council area”.
It also ordered substituted service on the respondents by delivering the processes in this suit to any senior officer at their respective offices”.
The case was adjourned till 8th day of November 2018.
Meanwhile the Code of Conduct Bureau has petitioned Onwusibe, before Governor Okezie Ikpeazu for his failure to declare his assets.
Onwusibe is also the PDP flag bearer for Isiala Ngwa North House of assembly.
The director CCB in the state, Mrs Chisara Chukwu, in the petition appealed to the governor to intervene and compel Onwusibe and one Chukwuemeka Nwachukwu a member of the local government service commission, to comply with the constitutional requirements for public officers in declaring their assets.
In the petition titled ‘Non declaration of assets on assumption of office”, dated April 18th, 2018, which was made available to newsmen in Umuahia on Monday, November 5.
The petition partly read, “I wish to inform you that the following persons whom you have confidence to work with assumed office without declaring their assets which is a breach of the code”.
“I have used all the strategies but it has proved obstinate, then I decided to report to you as the father and head of this state. Sir could you do me a favor by doing whatever you can do so that they can fulfill their 1999 obligations towards constitution of the federal republic of Nigeria”.
When contacted Onwusibe said he dully filled and summited his his assets declaration form to the CCB office in the state.
He said he would not comment more on the matter since the case was on going in the Court.
