The Supreme Court has affirmed Samuel Onuigbo as the senatorial candidate of the All Progressives Congress (APC) for Abia Central.
In a judgment on Friday, a five-member panel of the apex court affirmed the December 2022 decision of the Court of Appeal, Owerri, which nullified the candidacy of Emeka Atuma.
The judgment was on the suit appeal by Atuma, marked: SC/CV/1626/2022, which was applied to a similar appeal by the APC, marked: SC/CV/1627/2022.
Justice Emmanuel Agim, who read the lead judgment prepared by Justice Adamu Jauro, held that the appeal was without merit and proceeded to dismiss it.
The Court of Appeal had in its judgment, ordered the Independent National Electoral Commission (INEC) to recognise Onuigbo as the authentic candidate of the APC, having won the primary election for Abia Central Senatorial District.
Onuigbo, who represents Ikwuano/Umuahia Federal Constituency at the House of Representatives, had appealed the earlier judgement by Justice Evelyn Anyadike of the Federal High Court sitting in Umuahia, which recognised Atuma as the flag bearer.
